Ivera Medical Corporation Files Suit Against Excelsior Medical Corporation for False Advertising and Unfair Competition

Ivera Medical Corporation headquartered in San Diego, CA, filed suit in the U.S. District Court, Southern District of California (Civil Case No. 11CV2185 DMS WMC) against Excelsior Medical Corporation of Neptune, NJ, today for false advertising and unfair competition.

    SAN DIEGO, CA, September 28, 2011 /Health and Fitness PR News/ -- Ivera Medical Corporation headquartered in San Diego, CA, filed suit in the U.S. District Court, Southern District of California (Civil Case No. 11CV2185 DMS WMC) against Excelsior Medical Corporation of Neptune, NJ, today for false advertising and unfair competition.

Ivera manufactures, markets, and sells the Curos Port Protector, a device that disinfects and protects the entry port on needleless valves used with intravenous lines to reduce patient bloodstream infections. Excelsior sells a directly competitive product, SwabCap, throughout the United States.

In July 2011 a "MAUDE Adverse Event Report" was filed with the U.S. Food and Drug Administration by a California hospital. A subsequent investigation definitively cleared Curos of any involvement in the events which precipitated the MAUDE filing.

Cause for the civil suit came in September 2011 when Ivera learned that Excelsior was using the MAUDE report to orchestrate a mis-information campaign about Curos. Ivera is informed that Excelsior has urged its sales representatives and distribution partners to advise current and potential customers that use of Curos caps contributes to increased infections. Bob Rogers, CEO of Ivera Medical said, "This is an absolutely false statement and Excelsior is intentionally misleading hospital teams in an attempt to unfairly win business."
